Is It Illegal To Have Sex In A Car?

Well, it is not particularly illegal to have sex in a car right here in the United States, but that can easily turn into an illegal thing if you don’t pay attention to a few things. You see, practically in the entirety of the United States, there is no specific law that says that having sex in a car is illegal, but that doesn’t mean you’re pretty much okay doing that all the time. Let’s talk about it a little more to understand this in a better way.

The Real Deal With California Law (And What Makes It Illegal)

Sex In A Car

Not a lot of people have any idea about the law in California that kinda makes having car sex an illegal thing, but not like you think. You see, in Cali, there is this law called Penal Code 647(a). And? Well, it specifically doesn’t mention having sex in a car, but as per this law, having sex in a public area or doing some sexual stuff in public places is a crime. And sure enough, this law covers things like touching someone’s private areas or even your own, no matter what, if it’s clearly sexual. So, in a way, car sex can be counted as a crime, mainly if you’re doing that in some public area where people can clearly see you.

All in all, when you’re out and about, driving your car with your partner and you feel like having a little fun (you know what we’re talking about), then just make sure you aren’t parked somewhere people can see you. As per this law in Cali, no matter where you’re parked, like a public street, a parking lot, or even your own driveway, it is plain and simple: if someone can peek in and see what’s going on, it could be called “lewd conduct.” Pretty much.

What Can Happen If You Get Caught?

Well, let’s say you’re having fun in your car with your partner, and someone catches or sees you in the act while you’re clearly parked in a public area, in that case, if the cops catches you, well, you can very well be charged with lewd conduct, public indecency, or even disorderly conduct. No two ways about that! And yes, without a single doubt, this is pretty serious stuff. Sure, it won’t be counted as a serious felony or something like that, but still, it’ll be a big deal for you.

It is usually unlikely that you’ll be put in jail for something like this kind of act, but as per the law and some cases that have happened in the past, well, you could face stuff like six months in jail, a fine up to $1,000, or even probation, no joke.

So What Exactly Counts As “Public Sex”?

For some of you, well, it can be a little confusing, and we get it. So, here’s the simple version. See, if anyone outside your car could see you doing sexual stuff in your car (and sexual stuff counts as doing it, touching private areas, or even heavy kissing with clothes off) will be taken as “public sex.” Plain and simple!
