What’s This Costco Baby Wipe Lawsuit All About?
Since this was a big concern to so many parents out there, it was kinda inevitable that there will be a class action lawsuit against not only Costco but Nice-Pak Products as well. And sure enough, that is precisely what happened back on June 20th, 2024. Back then, a class action lawsuit was brought in a California Federal Court.
Sure enough, as you could have seen it coming from miles away, the main allegations of this lawsuit were: first of all, the company actually misled the customers by labeling the wipes straight up natural and toxin-free, where the reality actually was completely different and quite the opposite and that’s what got a lot of parents angry. In fact, these wipes contained something called the forever chemicals aka PFAS. And there is no denying too because this was proven in a third-party lab test.
Why These Days Everyone Is Talking About The PFAS?
Oh, that’s just because it has a lot to do with one’s health, so no doubt, a great discussion is going on in this topic right here in the country as well as in the rest of the world. For those who know little to nothing about these chemicals so far, well, PFAS (per- and poly-fluoroalkyl substances) are synthetic chemicals. So what? Well, the thing is, there are a lot of products that we use on a daily basis that contain these chemicals, and that’s kinda super concerning. We’re talking about products or things such as non-stick cookware, water-resistant clothing, and food packaging. And right now, after so many years of regular use of these, it is now that we’re seeing these being termed as “forever chemicals” because of their persistence in the environment and ability to accumulate in the human body over time.
By this point, it is not just speculation about PFAS; there are some actual, solid studies linking these chemicals to serious health concerns, even cancer. Yes, these chemicals have been found to cause cancer, different types in different people. So, that’s that.
Costco’s Been Here Before
Yes, in a way! Like, another lawsuit settlement back in July 2024 saw Costco paying $2 million, actually, that was for a matter unrelated to chemicals. The lawsuit was about their so-called “flushable” wipes, with allegations that the wipes caused plumbing damage and clogging of septic systems. Costco settled the lawsuit without actually admitting any wrongdoing, so a lot of people are still kinda upset about that. Nothing no one can do now!
What’s The Update Regarding All This?
Currently, the lawsuit involving PFAS is still in the early stages, so we can’t say much about it yet. It is what is known as a proposed class action. The court has yet to certify it as a proper class action. If it were to move forward and Costco were either to settle or lose, the case could bring about inordinately large damage awards or modifications regarding the manufacture and marketing of these wipes. So it is pretty much super important.
Another super scary thing about it all is that Costco hasn’t accepted any of this yet, like they didn’t admit that they’re in the wrong here. At least that’s what their stance is for now. And sure enough, because of this very attitude of Costco, there has been no settlement whatsoever.
